As a Firm which represents many of Frederick County’s Firefighters, we are proud to stand by their side as they fight for a fair and equitable seat at the bargaining table. Attorney Kenneth Berman spoke at a public hearing before the Frederick County Council in support of IAFF Local 3666 (Frederick County, MD Firefighters) regarding their recent political battle with the County government. In addition to Attorney Berman, Attorney Matthew Engler was also present at two of the public hearings to show his proud support for Frederick County’s Firefighters.

Local 3666 is in the midst of a political battle with the Frederick County Council regarding an issue that has already been decided, with overwhelming support, by the voters of Frederick County. In 2018, County voters approved (with over 70% in favor!) an amendment to the County Charter, called Question D, which requires the County and Local 3666 to submit to binding arbitration should an impasse ever arise regarding the bargaining of working conditions, wages, and other benefits for the firefighters. In approving Question D, County voters clearly and unequivocally expressed not only their support for their County Firefighters, but also their expectation that the County should take care of this hard-working and dedicated group of public servants.

When it came to the implementation of binding arbitration through legislation, the County Council passed a bill which completely undermines and guts both the will of County voters and the significance of Question D.

However, much to the disappointment of Local 3666 (not to mention the County voters who voted for Question D), when it came to the implementation of binding arbitration through legislation, the County Council passed a bill which completely undermines and guts both the will of County voters and the significance of Question D. In its bill, the County Council reserved for itself the ability to countermand and override the recommendations of the binding arbitrator, effectively making it no longer “binding”. This is completely contrary to Question D and, just as importantly, Maryland state law. In fact, the Maryland Court of Appeals, the highest court in Maryland, has spoken on this exact issue in Atkinson v. Anne Arundel County, where an identical County Charter Amendment in favor of firefighters in that County was undermined, in the same fashion, by their county council. The Atkinson Court could not have been any clearer when it stated simply and directly that the county council must adhere to the will of the voters and anything otherwise was unlawful. Rather than abide by this clear edict from Maryland’s highest court, the Frederick County Council is now walking down the same errant path as Anne Arundel County before them. Shame on them!

Al Rides Again (Over 20 years for charity)

Support Alan B. Gross as he rides in the 2019 Charity Treks - Tour de Champlain HIV/AIDS Vaccine Bike Trek. This bike tour will help raise much needed funds for researchers at UCLA and Emory University. 100% of donations will go directly to these institutions so they can keep working towards a cure.

Dear BSGF&D Friends & Family,

We would like to thank all who contributed to the Hurricane Sandy Relief Drive. We could not be more grateful to all of those who took the time to drop off donations at our offices. We were able to collect boxes and bags full of clothing, household items, toiletries and other needed items to fill a truck. Here is a picture of the truck at our Gaithersburg office in between stops.

Alan Gross Leads BSGF&D Community Service

Many of you know Alan as their attorney. Few of you know that his passion to help others is a life style. For more than a decade, at least once a month, Alan leaves work and drives to Food and Friends. He scrubs his hands, puts on gloves, hairnet and apron and pitches in to prepare food for thousands of disabled home bound people in need. Recently, he kicked off Berman, Sobin, Gross, Feldman & Darby's community service program by leading several of our employees on multiple visits to the Food and Friends kitchens.

When he is not preparing food, he may be found training on his bicycle by screaming down winding mountain roads at over twenty mile per hour. The training is necessary because two times a year, Alan and his bicycle group, Charity Treks, join others on multi-hundred mile rides to raise awareness and money for AIDS research. Thanks to the efforts of Alan and his group more than a million dollars has been donated to Emory University and UCLA, where it has been directed towards finding new treatments for AIDS related cancer.

When Alan is not assisting his clients, working in the kitchens for the disabled, or raising money to find new treatment for AIDS, he still is not resting. Two or three times a year Alan works with the Rock Creek Park Foundation to clear Rock Creek Park of trash. Next time you enjoy a quiet walk in the park, you might consider contacting Alan to see how you can help.

Alan does all this quietly, and without fanfare. He is a devoted member of our community and a devoted attorney to his clients.
